Scope and Content
The Office of the General Counsel in the Texas Governor’s Office was responsible for providing legal advice to Governor Rick Perry. Plans and planning records relate to the process of planning new or redefined programs, services or projects of the Governor’s Office during Governor Rick Perry’s term in office. The Indian Affairs program focused on the state’s relationship with Indian tribes in Texas. Types of records include legal records and legal research, correspondence, newspaper clippings, manuals, handbooks, and reports regarding Indian gaming law and compacts, and one compact disc. These records represent communication between general counsel staff and representatives from the Kickapoo, Alabama-Coushatta, and Tigua tribes, along with various other tribes mentioned for their historical and legal relevance on a federal level with U.S. Department of the Interior, Bureau of Indian Affairs. Materials date 1990-1993, 1995, 1997-2005, 2008, bulk 1991-1993, 1995.

The majority of the records are legal documents and legal research related to Indian gaming in Texas and other states, along with interoffice memos and correspondence discussing these legal cases, the state’s response, and the tribal leader’s requests; newspaper clippings related to individual cases; manuals, handbooks and reports regarding Indian gaming law and compacts; and historical documents from earlier state interactions with Indian tribes in Texas. Legal cases represented in these records include: Ysleta Del Sur v. State of Texas, Alabama-Coushatta Tribes of Texas v. State of Texas, Artichoke Joe’s v. Gale A. Norton, et al., and Pueblo v. Bush, among others. Correspondence and documents from the National Governor’s Association are found in this series and focus on federal regulations and committees related to Indian gaming and gaming reform. Also included are compacts between the U.S. Department of the Interior, Bureau of Indian Affairs and individual tribes throughout the United States. Additional correspondents include the Texas Lottery Commission, Texas Economic Development, and Texas Department of Family and Protective Services. Besides these legal cases, records reflect the communications between government officials and tribal leaders related to economic development and revenue opportunities on Indian reservations.

Individual tribes represented in these records include Ysleta Del Sur Pueblo, Kickapoo Indian Tribe, Alabama-Coushatta Tribe of Texas, Choctaw Indians of Texas, Lipan Apache Band of Texas, Kialegee Tribe, Bad River Band of Lake Superior Chippewa, Mississippi Band of Choctaw Indians, the Grand Traverse Band of Ottawa and Chippewa Indians, the Crow Indian Tribe, Assiniboine and Sioux Tribes of the Fort Peck Reservation, Cocopah Indian Tribe, Cow Creek Band of Umpqua Tribe of Indians, Cheyenne River Sioux Tribe, Crow Creek Sioux Tribe, Flandreau Santee Sioux Tribe, Lower Brule Sioux Tribe, Oglala Sioux Tribe, Rosebud Sioux Tribe, Hannahville Indian Community, Coushatta Tribe of Louisiana, Tunica-Biloxi Indian Tribe of Louisiana, Chitimacha Tribe of Louisiana, Ute Mountain Ute Tribe of Colorado, Upper Skagit Indian Tribe, Jamestown S’Klallam Tribe of Washington, Yavapai-Prescott Indian Tribe, Nooksack Indian Tribe of Washington, the Sac and Fox Tribe of the Mississippi in Iowa, Southern Ute Indian Tribe, Swinomish Indian Tribal Community, Squaxin Island Tribe, and Tulalip Tribes of Washington. The names of these tribes are the way they appear in the records themselves and may not reflect current federally or state recognized tribal names.
